High School student military reserve trainee arrested for unloaded gun in truck

(December 13th, 2006) A Columbia, MO Rock Bridge High School student was arrested on suspicion of unlawful use of a weapon and is free on $4,500 bond.

The student had an unloaded "AR-15" semi-automatic rifle in the covered bed of his pickup truck because he was going to target practice after school.

It will be interesting to see what disciplinary action the school district takes.

What is much more important is whether this student will be prosecuted under State gun laws or the 1990 Federal Gun Free School Zones Act (18 US Code sect. 922(q)(1)(A)).

Will this be another example where Gun Control Laws are used to prosecute a law abiding citizen who had no criminal intent.

A gun is useless with no ammunition.


Many people think that the government are the only ones that the founders wanted to have guns and they base this on supreme court rulings. They have forgot the true intentions of the 2nd amendment.

Just another example of how the fearmonger's in the dominant media culture and major sectors of our government, have both combined to perpetuate a fear of inanimate objects. The man is a SOLDIER for God's sake! He is NOT anything like the punks at Columbine, which is probably the excuse that will be used to (try) and punish him.
Not to mention the fact, that everything else aside, he has a simple Constitutional right to carry that firearm. Schools are declared "No drug zones" No gun zones" No breathing zones" etc. in order to further advance liberty robbing legislation.

It will be interesting to see how this comes out. The article mentions the rifle was "in the covered bed of Dudley’s pickup". He's 18, which I believe is legal age in Missouri for a rifle.

Under Missouri law, the interior of your vehicle is considered "your premises" and is treated the same as inside your home. It is lawful for someone of legal age to possess a rifle (age 18+) or a handgun (age 21+) within their premises. If it stays in your vehicle it is legal, even on school property.

Since he is under age 21, it is my understanding (I'm not a lawyer) that he cannot conceal the rifle. You must be at least age 21 for that.

Although the article does not clearly say, a gun case is mentioned in which "ammunition was found". If he had the rifle in the case, this is an acceptable method of transport. It is my understanding that this is not considered "concealing" the weapon, so long as the case itself is not concealed.

I think much of it will come down to if the court considers the covered bed of a truck to be part of the interior of a vehicle.

Actually, I think what it will really come down to is how badly the anti-gun crowd decides they want to make an example of this kid. Real shame too, sounds like he was a good kid.
